Is Stipend Income Taxable?

The taxation of Stipend Income has been a matter of much debate. From a purely factual standpoint, the Income Tax Act does not mention ‘stipend’. 

‘Salary’  received by an ‘employee is taxable in the hands of the employee. 

Under Section 17(1), Wages, pensions, gratuities, fees or commission or profits in lieu of salary, advance salary, and leave salary standing to the credit of the employee have all been included under the definition of salary. It is evident when a salary is paid that an employer-employee relationship exists.

The Income Tax Act has further laid down that  ‘scholarship granted to meet the cost of education   is exempt from  Income Tax  under section 10(16).’ 

What is Stipend Income?

Now the question arises should we consider Stipend as ‘Salary’ or as ‘Scholarship’?

For this, we must review the terms under which such a Stipend is paid. When a Stipend is paid to further a person’s education, we need to test whether it qualifies as a Scholarship. 

The person may exhaust this money fully or end up saving some of it – as long as this has been paid purely in pursuit of a person’s education and is in the nature of a scholarship, it shall be exempt. 

This will have no relation to the position of the person. Usually, Articles pursuing CA may earn a Stipend, or a professor may receive a stipend for carrying on research work. 

The purpose of such payment is important here, not the value or the way this has been spent. 

Research fellowships, and grants received from universities may all be exempt when their nature is to support further education. 

Doctors receive Stipend at Hospitals  

Usually, doctors earn stipend as they pursue a higher degree at a hospital. Their work by the doctor is similar in nature to that of a full-time employee. The doctor is gaining experience from such work and performs duties like regular doctors – in such cases your Stipend may be taxed.

MBA or Engineering Graduates receive  Internships Stipend 

Some companies may even offer accommodation. The Stipend letter may or may not include a breakup as a salary letter does. It may or may not be similar to the employment letter offered to a full-time employee. However, if this payment is made for you to gather experience and perform services similar to an employee, such Stipend income shall be taxable. 

TDS on Stipend  

Some companies may not deduct tax on Stipend; it may still be taxable in your hands, depending upon the nature of the terms or such payment. 

Difference between Salary and Stipend

A stipend is a fixed sum of money paid periodically for specific purposes, such as internships, fellowships, or apprenticeships.

A salary is a regular payment made to an employee, typically on a monthly or bi-weekly basis, for their work or services.

Stipends are typically associated with situations where the recipient is not a full-time employee, such as students, interns, or trainees.

It is usually associated with a formal employment relationship where the individual is considered an employee.

Stipends are common in educational or training contexts, providing financial support without the full benefits of employment.

Salaried employees often receive additional benefits such as health insurance, retirement plans, and paid time off.

The tax treatment of stipends can vary. In some cases, they may not be subject to employment taxes, but they might still be considered taxable income.

If your payer has already deducted tax and issued you a form 16, this shall be taxed under the head Salaries; otherwise, it is usually taxed under the head Income from Other Sources. 

Expenses are Allowed to be Deducted from Stipend? 

Individuals can claim deductions for expenses incurred while earning the stipend, such as travel or research-related costs if these are directly related to the stipend's purpose and are supported by valid documentation. Additionally, you can save tax in the form of  Section 80 Deductions .

Eligible candidates shall have to appear in i3T – Integrated Test for Teacher Trainee conducted by the Indian Institute of Teacher Education (IITE) as per schedule mentioned in the brochure. Admission will be given as per merit list prepared based on marks of i3T

Junior Research Fellowship

Indian Institute of Teacher Education, Gandhinagar (IITE) hereby invites proposal for Junior Research Fellowship (JRF) leading to Senior Research Fellowship (SRF) under its Ph.D. Programmes being offered; the objective of this fellowship is to provide opportunity to NET-GSLET-GSET-JRF qualified candidates to undertake advance studies and research in the fields of Education leading to Ph.D.  Degree in Education

Fellowship : Rs. 31000/- per month.

The Fellowship assistance will be normally for a period of three years and extendable up to four years. It shall be Junior Research Fellowship for the first 18 months for Ph.D. Scholars and Senior Research Fellowship for the next 18 months for Ph.D. Scholars

Prerequisites:

The Fellowship shall be open for all Ph.D. Scholars of the University subject to the following eligibility criteria.The candidate must be admitted in full time (Regular) Ph.D. Programmes at the UniversityThe candidate should not be receiving any grant or research assistance by whatever name called from any other source including UGC.The candidate should not be engaged in any part-time or full time employment of any nature during the entire tenure of Fellowship.The candidate must be present full time at the University during the period of the fellowship.Candidates who are UGC-NET and/or GSLET/GSET qualified can apply for JRF/SRF.

Duration Full Time - 3 Years(Minimum 6 Terms) Part Time - 4 Years(Minimum 8 Terms)
Prerequisites Master degree or its equivalent in the subject of Education with at least 55% marks (or equivalent grade) of any University/Higher Learning Institution recognized by UGC and/or DEC, in the relevant discipline.
Schedule/Timing As instructed by the research supervisors.

PhD-Program: DIBT / Doctoral Program in International Business Taxation

We are proud to announce that the WU has a “Doctoral Program in International Business Taxation” (DIBT) that is going into its 12th year. This is a 3-year PhD program offered in English only, and it is open to outstanding students from all over the world who are interested in an excellent doctoral education preparing them for doing research in international business taxation. The Doctoral Program provides high-quality interdisciplinary training for graduates in the field of international taxation, including and combining the disciplines of public finance, international tax law and cross border tax management. Although students will write their doctoral thesis in their own discipline (law, business, public finance, economic psychology), they will be exposed to intensive interdisciplinary discussions during their stay in Vienna. The opening of traditional tax training to other disciplines, such as economic psychology, history, political science, ethics and legal philosophy (always in the context of taxation), promotes a broadening of horizons and a more comprehensive approach to research questions. Best possible standards in both research and teaching are guaranteed by a faculty of renowned scholars, who have published in the most prominent journals of their respective research fields and have proven willingness and ability to do interdisciplinary research. The most distinguished professors in tax law, business administration and public finance are either on the faculty of this program or have agreed to teach courses, give workshops or to discuss research ideas and preliminary research results with the PhD students in Vienna. Students will be integrated into the research activities of the WU institutes dealing with taxation issues. During the first year, students will be required to attend many comprehensive courses to provide the basic knowledge necessary for research within their own discipline as well as for interdisciplinary research. The second and the third years will be dedicated to seminars on theories and methods and perspectives on taxation, a research stay abroad, additional optional workshops, and especially to research on the thesis. Throughout the three years, a research seminar will supplement the students’ training. We will admit a very limited number of students every year. For them tuition fees will be waived and they will be provided with the best possible conditions for conducting research. The DIBT continues to be supported by the Austrian Science Fund (FWF) and for a certain number of students we are therefore able to provide funding for their three-year stay at WU in Vienna! Current applications will be accepted from November 1, 2021 to February 15, 2022 for the upcoming academic year 2022/23. The mission of the PhD Global Tax Symposia  (GTS) is to become the first interdisciplinary mobile research platform on fundamental issues of international taxation. It is grounded on the belief that crossing African, American, Asian, Asian-Pacific and European perspectives is beneficial to all participants, especially in the current political and economic global context.

A student who is in possession of a taxation-orientated master’s qualification on NQF LEVEL 9 may apply for admission to this qualification. Alternatively any other related qualification with the program-specific minimum level of competency on NQF LEVEL 9, and related experience which is considered relevant and sufficient by the Department of Accountancy. Finalization of registrations for the program (and/or continued registration) is subject to students complying with departmental-specific requirements. Such requirements usually include preparatory work leading up to a research proposal that is approved by the department. Possible examples of the preparatory work are pre-reading, literature reviews, concept developments, and successful completion of short courses aimed at skills and or knowledge development. Students may also be required to successfully defend their research proposals at the special discussion sessions.  

First Semester  

  • Thesis: Taxation * TTA10X1 – 360 credits

Second Semester  

  • Thesis: Taxation * TTA10X2 – 360 credits

·          A requirement for awarding this qualification includes that the students will, with the submission of their traditional thesis, submit two articles for the possible publication.  

Please note: A student will only pass and get the 360 credits for either TTA10X1 or TTA10X2.

Tax on scholarship/Stipends to students

There are a numerous scholarships available to students for studies. The Universities, Colleges, Schools offer scholarship to meritorious students on the basis of their last performance. Some NGOs also award scholarships to needy and poor students to pursue their studies. Some Old Boys Associations also award certain scholarships. The Central/State Government also award different types of scholarships on the basis of past achievements, financial status with quota for reserved, backward & the disabled.

The scholarships are generally meant for meeting the cost of current education but sometimes it is awarded as an incentive to achievement in academics, sports and co-curricular activities. Some scholarships are awarded for excellent performance, like topping in the school/college or scoring highest marks in a particular subject. The scholarships are sometimes utilised for purposes other than education or the scholarship awarded is utilised after a certain interval of time.

In simple terms, ‘scholarship’ means a grant which has been achieved on the basis of the academic or other achievement to support a student’s education. Thus, it needs to be ascertained whether the amount received as Scholarship is liable to be taxed under the provisions of the Income Tax Act. It is pertinent that any kind of scholarship granted to a student to meet the cost of education is exempt under Section 10(16) of the Income Tax Act.  Section 10(16) of the Income Tax Act reads as under:

Incomes not included in total income.

10. In computing the total income of a previous year of any person, any income falling within any of the following clauses shall not be included—

(16) scholarships granted to meet the cost of education;

Thus, if any student gets a monthly scholarship or a lump sum scholarship or a stipend and the same is utilised to meet the cost of education then the same is not taxable under the Income Tax Act.

The benevolent Provisions of section 10(16)  exempt any scholarship granted to meet the cost of education. Thus, any scholarship received by the deserving students to meet the cost of education is exempted from income tax in terms of section 10(16) of the Income Tax Act. The only condition of exemption is that the scholarship amount should be used to meet the education expenses.The entire amount of scholarship granted to meet the cost of education is exempt and there is no upper limit prescribed for exemption under the Income Tax Act.

The following  scholarships/Stipend are exempt u/s 10(16) of the Income Tax

1. Any amount received by the employee from the employer towards the scholarship of his child is eligible for exemption under section 10(16).

2. Any amount received by the employee from the employer to aid his own studies and research is eligible for exemption under section 10(16).

3. Research fellowships in all fields

An important question arose before the ITAT in the case of Income-Tax Officer vs Dr. V. Ramalinghaswami 1983 6 ITD 491 Delhi wherein the question arose was whether the exemption granted in educational fee of wards of teachers studying in the same school exempt u/s 10(16) of IT Act.The ITAT held that the said scholarship clearly fell under section 10(16) and is exempt from levy of Income Tax.

A stipend received for meeting the cost of education is also treated as a scholarship within the meaning of Section 10(16) of the Income Tax Act.

It would be trite to refer to the case of Ratnakar Rao vs ACIT 128 ITR 527 wherein it was held by the Karnataka High Court that the stipend paid by the Hospital for securing training, study & research in a branch of medicine is in the nature of Scholarship and falls under the ambit of Section 10(16) of the Income Tax Act and is therefore not Taxable.

It is relevant that in the case of CIT vs VK Balchandran 147 ITR 4 the Madras High Court held that grant-in-aid received by the assessee for advance Research in a foreign University falls within the meaning of Section 10(16) of the Income Tax Act and is not taxable. The Court clarified that if the payment is in the nature of remuneration for services rendered, it shall be exigible to Income Tax.

The Revenue should not deny the benefit of the benevolent Provisions of  the Income Tax where the provision is clear like the aforesaid Section 10(16).
