Working Papers Repositories

After browsing current awareness services for ideas, hopefully you’re starting to have a few possible topics. Digging into working papers is a good next step. Working paper repositories host collections of scholarly articles not yet published or in final form. The benefit of searching in working paper repositories is to gain a sense of the current academic conversation on a topic.

  • SSRN (Social Science Research Network) SSRN is a working paper site used by most U.S. law professors. Accessing it through HOLLIS will allow you to set up an individual account and subscribe to email alerts.
  • Law Commons This open access working paper site is easy to browse by topic, author, and institutional affiliation.
  • NBER Working Papers The National Bureau of Economic Research hosts working papers related to finance, banking, and law and economics.
  • OSF Preprints Multidisciplinary repository more global in scope than those listed above.

Academic Literature

As you begin to settle on a topic, you'll want to explore the legal academic literature. If your topic is not solely legal in nature, but falls in other academic disciplines like economics, sociology, political science, etc. you'll want to use HOLLIS and Google Scholar as you explore and refine your topic.

  • Hein Online Law Journal Library (Harvard Key) Provides pdf format for law review articles in 3200 law journals. For most, coverage is from inception. Includes a good collection of non-U.S. journals.
  • Lexis+ Law Reviews and Journals (HLS Only)
  • Westlaw Law Reviews & Journals (HLS Only)
  • LegalTrac Topic Finder (HLS only) LegalTrac is an index (descriptions of articles) and has some full text. It is included here for its topic finder tool which allows you to put in some general topics, and then refine the terms to generate a list of linked articles.

Academic Articles, Books and Book Chapters

  • HOLLIS Catalog and Articles Beyond finding the books, ebooks, and journals owned by the Harvard Library system, using HOLLIS in its default mode (Catalog & Articles) allows you to find articles from many subscription sources. Before settling on a paper topic, running some searches in HOLLIS is a must.
  • Harvard Google Scholar Google Scholar limits results to scholarly research publications. Harvard Google Scholar will (usually) allow you to link through to content from Harvard-subscribed sources.

Dissertations, Theses and Papers

As you refine your topic ideas, it is often helpful to browse the titles of dissertations and papers by SJDs, LLMs, or JD students, either generally, or those which touch on your subject area. This can help you understand how people have framed their research topic in a discrete, specific way. 

  • Proquest Dissertations and Theses (Harvard Key) This database includes dissertations and theses from many academic institutions but has not included HLS SJD dissertations or LL.M. papers in recent years.
  • HLS Dissertations, Theses, and JD Papers The library holds HLS student papers in print format. This guide describes our collection and how to find them using HOLLIS.
  • Global ETD Search (Networked Digital Library of Theses and Dissertations) Global in scope. Collectively search academic repositories of theses and dissertations.

Tips on Finding a Faculty Advisor

HLS LL.M. papers require faculty supervision. Discussing your topic with a potential faculty supervisor can be an important step in solidifying your topic ideas. 

  • HLS Faculty Directory The directory can be searched or browsed by area of interest. Note that some professors are here for only part of the year. Faculty supervisors must have a teaching appointment in the semester in which the paper is to be turned in.
  • HLS Course Catalog This is the best source to determine who is currently teaching in your topic subject area.
  • HLS Faculty Bibliography This collective list of publications of the HLS faculty can be searched and limited by date.

Maintain good communication throughout the process . As you work on the project, check in regularly to let your supervisor know of your progress, to confirm that you are on the right-track, and to get additional guidance. If you are unsure about the extent of communication your supervisor desires, consult with other attorneys who have successfully worked with your supervisor. 

Timely respond to e-mails . It is important to timely acknowledge e-mails that your receive, even if you cannot get to the substance of the e-mail right away. For example, if you are sent an e-mail asking for a bit of research, respond to the e-mail at your earliest opportunity to let the sender know that you received their e-mail and advise the sender of when they can expect to receive at least some preliminary work on the project.

Project confidence . As a new attorney, it is natural to feel overwhelmed and unsure of your abilities when given a new assignment. Do not let these feelings compromise your professionalism when communicating with your supervisor. Show enthusiasm for the project and ask appropriate questions about deadlines and suggestions for getting started. Should you feel confused or overwhelmed as you work on a project, identify what it is you need guidance on, such as help prioritizing research items or confirmation that you are researching in the right sources, and go to your supervisor with specific questions.

Your research strategy will vary depending on your legal issue and the nature of your project. While there is no one path that works for every research question, these steps are a useful starting point:

Determine the relevant jurisdiction . Before you begin your research, you need to determine which law is controlling for your issue. Is the issue governed by state or federal law? For state law questions, what state(s) law is at issue? For federal law questions, what are the relevant Circuit and District courts?

Identify the legal issue and determine keywords to describe the issue . It is common for those new to legal research to go directly to a search engine and start typing away, hoping to find an answer quickly. Taking some time to step back from the search engine and think through the issue to be researched will save you time in the long run, as it will make your searching more efficient and effective. Identify what area(s) of the law are implicated by your issue, what is the question to be researched, what topics are implicated by that question, are there sub-issues that should be considered? You may find it helpful to write out the question(s) that you are researching. Also, think through keywords that describe your issue that would be useful for generating good searches. For those keywords, think through synonyms that may be used in lieu of those words.

Begin your research by consulting a secondary source . Secondary sources offer guidance on legal topics and questions. They are a critical resource to help you get a "lay-of-the-land" regarding your issue and will identify statutes and leading cases to jump start your research.

Locate relevant statutes . If there is an on-point statute for your issue, look up that statute in an annotated code. Take note not just of the language of the specific statute but also review the rest of the "chapter" in which the statute appears to identify other related and relevant statutes. For each relevant statute, review the annotations for citations to cases and secondary sources.

Find relevant cases . If you have identified relevant cases by looking at secondary sources and/or annotated codes, review those cases. Use the on-point headnotes of each case to search for other relevant cases in your jurisdiction, and use the citator (Shepard's in Lexis, KeyCite in Westlaw, and BCite in Bloomberg) to identify cases that have cited to your cases. Also, do additional keyword type searches to find other relevant cases.

Confirm that your authority is still good law . Use a citator (Shepard's in Lexis, KeyCite in Westlaw, or BCite in Bloomberg) to confirm that your cases and statutes are still good law.

One of the trickiest research tasks is knowing when your research is completed. Legal analysis is nuanced, and thorough research involves looking at a number of sources and types of materials. Finding one on-point authority does not mean your research is complete. However, it also is simply not possible to run every conceivable search in every conceivable resource and review every conceivable search result. Good legal researchers find the sweet-spot between one-and-done and scorched-earth type research.

The following may signal that you have found a good spot to conclude your research:

Your searches keep turning up the same set of relevant authorities. If you are no longer finding relevant new sources, you have probably found the bulk of what is available.

You have searched in a variety of available sources (i.e. secondary sources, cases, etc.) and resources (Westlaw/Lexis/Bloomberg, government websites, other available resources).

You have searched using a variety of keywords.

You have searched using a variety of methods (using secondary sources to find primary authority, keyword searching, mining headnotes to explore Topics/Key Numbers, reviewing citing references, etc.).

For your most relevant search results, you have reviewed both the sources they cite and sources that cite to those materials.

Current Awareness Services in Print

Some services providing analysis of current development in the field and reports of recently decided cases are available in print in the Law Library. Searching the catalog for these tools can be difficult at times. Consider using “reporter” and your legal topic as a keyword search. Other words that may prove useful include “weekly,” “alert,” “current,” “news,” “analysis,” or “newspaper” and then use one of these in conjunction with “law” or “legal.”

Finding a Paper Topic

Finding a topic is the first and often the most vexing challenge for law students writing a paper, note or comment for a class or law review. Choosing a paper topic that is neither too broad nor too narrow, both pertinent and topical, and not over nor under written about can be an exercise in frustration. Finding a Topic

One of the most important yet challenging aspects of writing a research paper is selecting an appropriate topic.  When selecting a topic, make sure that it is interesting to you and your audience, well-defined, manageable, novel and worthy of publication. If you need help finding a research topic, you can start by:

  • Examining legal developments
  • Searching for a novel case or a legal issue where courts have split on their interpretation of the law
  • Browsing recent scholarly publications
  • Mining topic ideas, including calls for papers and writing competitions
  • Talking to people
  • Keeping up to date with current affairs, e.g. news items can generate topic ideas

Novel Cases

A common approach to finding a topic is to focus on a case that raises a novel issue of law. To find these cases, search for legal developments (see Legal Developments) or browse recent cases before the Australian High Court or highest appellate court in other countries.

Unresolved Legal Issues

Another common approach to finding a research topic is to examine an unresolved legal issue. Unresolved legal issues can occur when courts have split in their interpretation of the law, leaving the ultimate meaning of the law unresolved. In the United States, this is known as a 'circuit split' because it is based on federal circuit courts interpreting the same legal issue differently. These sorts of issues are ripe for appeal to the US Supreme Court, the highest court in the land. 

A research topic may describe the split, identify any issues that may be influencing the courts, and propose a way to distinguish the situations or resolve the discrepancy. These topics can be very timely and relevant. However, if the discrepancy is resolved before your paper is completed, the topic can be rendered entirely obsolete. Because these topics are so popular in the United States, there are resources dedicated solely to tracking circuit splits, including the following:

  • Seton Hall Circuit Review A law review dedicated to covering the United States federal circuits. The section entitled 'Current Circuit Splits' provides brief summaries of the circuit splits identified in federal court of appeals opinions.

Independent Counsel and Arbitrator, Menish Arbitration LLC

As an associate with Freshfields Bruckhaus Deringer based in New York, Lexi Menish is looking forward to work involving international arbitration in the firm’s dispute resolution group.

Menish became interested in pursuing a career in international law while working in China as an English teacher and private school administrator. “The rule of law in China is evolving very quickly, but there are many limitations on people’s legal rights,” she said. “During my last year there, I became especially interested in studying international law because I was helping to run a business.”

Menish did most of her research on law schools from China. Vanderbilt ranked high on her list both because of its location near her hometown of Louisville, Kentucky, and its strong International Legal Studies Program . “Vanderbilt’s international faculty is incredibly well-connected, and they make a special effort to help students find internships and jobs,” she said.

After her 1L year, Menish studied international law with Vanderbilt in Venice and then spent six weeks in The Hague working for attorney Guenael Mettraux on the defense team at the International Criminal Tribunal for the Former Yugoslavia, an internship she secured with help from Professor Michael Newton . Mettraux also served as a consultant for the defense in the Special Tribunal for Lebanon, and Menish continued to support his team during her 2L year with research she completed in Newton’s International Practice Lab and through an independent study. “I had an opportunity to research case law from all international criminal tribunals and human rights courts,” she said. “My project involved international legal standards for the restriction of religious practices in prison for clients M. Mettraux was representing, and it ended up being a 30-page survey of customary international practice comparing various national standards with jurisprudence from international criminal and human rights courts.”

Menish secured a position as a summer associate with Freshfields Bruckhaus Deringer in New York in summer 2010 through Vanderbilt’s On-Campus Interviews (OCI) and joined the firm permanently in summer 2011. “Dean [Elizabeth] Workman was very helpful throughout the process,” she said. “She knew the interviewer and gave me helpful feedback before my call-back interview.”

She recommends that all students interested in an international law practice enroll in the Vanderbilt in Venice summer study program after their 1L year. “Vanderbilt in Venice made a huge difference for me at OCI,” she said. “All four of the courses in Venice focus on international law. Going into interviews at the beginning of my 2L year, I was able to say that I’d taken a course in international commercial arbitration and discuss that area of law. That gave me quite an advantage.”

As a 3L, Menish worked with Newton to involve his Practice Lab students in several research projects for Mettraux. “One great thing about Vanderbilt’s International Legal Studies Program is that I was able to take substantive courses in international topics every semester, including arbitration, investment treaties, trade law, criminal law and business transactions,” she said. “I was then provided with many opportunities, through the Practice Lab and internships, to use and expand this knowledge through actual practice.” According to Newton, many students pursue independent research and practice lab projects related to international externships. “International Law Practice Lab projects are designed to help students build a solid base of experience, and they often generate interest in greater exploration of a particular issue as an independent study project or lead to an externship,” he said.

At Freshfields, she has joined the firm’s dispute resolution group and feels well-prepared to start work on cases involving international arbitration and commercial litigation. “That’s what I hope to focus on, and I am thankful to Vanderbilt for helping make that possible,” she said.

The law can be a complicated thing, even for seemingly simple matters. Wondering if the oak tree in your front yard is in violation of local zoning ordinances? Figuring that out could mean wading through a tall pile of regulations, all written up in confounding legalese.

A city zoning code can contain tens of thousands of meticulously detailed rules, regulations, and guidelines. Even if the 60-megabytes-plus size of the documents doesn’t crash your computer, you still have to try to understand it all. This is a daunting task even for legal experts. For laypeople, deciphering such a Byzantine set of rules borders on the impossible.

To that end, professors Ruzica Piskac and Scott Shapiro — from Yale School of Engineering & Applied Science and the Yale Law School, respectively — ​are putting artificial intelligence (AI) to work on your behalf. With advanced AI-powered tools, they are developing a system — known as a “lawbot” — that can review and parse zoning laws, tax provisions, and other intricate legal codes much faster than human lawyers. They named their related start-up Leibniz AI, after the 17th century polymath who dreamed of an automated knowledge generator.

To the user, the concept behind the lawbot is fairly simple: ask it a legal question, and it provides you with an understandable and accurate answer.

More than just offering helpful advice, the two professors see their system as helping to democratize the legal system. Getting reliable information that isn’t cost- or time-prohibitive empowers the average person to understand their rights and make more informed decisions.

The system harnesses the power of large language models, which can understand and generate human language — essentially, they streamline legal analysis and allow users to ask questions and get answers in plain language. Crucially, the system also applies automated reasoning, a form of AI that uses logic and formal methods to reliably solve complex problems. Today’s popular chatbots have shown a tendency toward “hallucinating” — that is, asserting false statements as true. Obviously, this isn’t something you’re looking for in a lawyer. But thanks to automated reasoning, the Leibniz AI lawbot offers only clear-headed responses. By systematically verifying and validating each step of the reasoning process, it significantly reduces the potential for errors.

“ We want to use those insights that we already learned about reasoning in the legal setting,” said Piskac, associate professor of computer science. “Then we can apply them to real-world settings so that regular users like me or someone else can ask their questions. For instance, if I have an extra room, am I allowed to rent it on Airbnb?”

There are currently AI-based startups focused on providing legal services. Unlike Piskac and Shapiro’s system, though, none use automated reasoning or any other sorts of formal validation of their results. Instead, they tend to rely mainly on unreliable large language models.

Shapiro, the Charles F. Southmayd Professor of Law and professor of philosophy in Yale’s Faculty of Arts and Sciences, said developing a lawbot seemed like a great opportunity to show the promise of AI technology. But increasing access to legal information through large language models brings the obligation to ensure that the information is accurate — the stakes are high when it comes to the law.

That’s where the system’s techniques of automated reasoning, verification, and logic solvers come into play, he said. The result is nuanced legal information delivered quickly and accurately at the user’s fingertips.

A ‘deeply interdisciplinary’ collaboration

Piskac and Shapiro began working together after Samuel Judson, Piskac’s Ph.D. student, proposed applying for a research grant from the National Science Foundation (NSF). The proposal called for developing accountable software systems, a project that required legal expertise. Piskac emailed Shapiro, whom she’d never spoken with before.

“ I’m like, ‘Hey, I’m a person who likes logic. Would you like to work with me on a project involving logic and the law?’” Piskac said. “And Scott answered within a couple of minutes: ‘Yes. I like logic, too.’” Soon after, together with Timos Antonopoulos, a research scientist in Piskac’s group, they applied and were awarded an NSF research grant for their project on accountability.

The work they’ve accomplished wouldn’t have been possible without both researchers participating, Shapiro said.

“ One of the things that I really love about this project is how deeply interdisciplinary it is,” he said. “I had to learn about program verification and symbolic execution, and Ruzica and her team had to learn about legal accountability and the nature of intentions. And in this situation, we went from a very high level, philosophical, jurisprudential idea all the way down to developing a tool. And that’s a very rare thing.”

Each field of study comes with its own terminology and ways of thinking. It can make things tricky at first, Piskac said, but having a common interest helped overcome those obstacles.

“ Scott would say something, and I would say, ‘No, this is not correct from the computer science perspective.’ Then I would say something and he would say, ‘No, this is not right from the legal perspective,’” she said. “And just this immediate feedback would really help us. When you’re sitting close to each other and comparing and discussing things, you realize that your goals and ideas are the same. You just need to adapt your language.”

Yale Engineering Dean Jeffrey Brock said the collaboration is a great example of how the school can direct the conversation around AI and make impactful contributions to the rapidly evolving field. In addition to AI-related projects with Yale Law School and Yale School of Medicine, he noted that Engineering has been working with the Jackson School of Global Affairs on cybersecurity, and more collaborations are in the works.

“ Engineering is lifting Yale by helping other schools and disciplines on campus to thrive,” Brock said. “In the era of generative AI, fields like law and medicine will become inextricably intertwined with technology development and advanced algorithms. For these schools at Yale to maintain their preeminence, they are increasingly engaged with our mission, and we want to help make their work even better. That’s happening now, and we expect it to continue to an even greater degree in the future.”

He also noted that the cross-disciplinary approach is reflected in the school’s curriculum. Piskac and Shapiro, for instance, co-teach “Law, Security and Logic,” a course that explores how computer-automated reasoning can advance cybersecurity and legal reasoning. And “AI for Future Presidents,” a newly offered course taught by Professor Brian Scassellati, is designed for all students and takes a general approach to the technology and its societal impacts.

Putting the car on the stand

Our lives are increasingly entwined with the automated decision making of AI. Autonomous vehicles use AI to share our roads, health care providers use it to make certain diagnoses and treatment plans, and judges can use it to decide sentencing. But what happens when — even with the best intentions — things go wrong? Who’s accountable, and to what degree? Algorithms can fail — they can cause fatal accidents, or perpetuate race- and gender-based biases in court decisions.

In a project that combines computer science, legal rules, and philosophy, Piskac and Shapiro have developed a tool they call “soid,” which uses formal methods to “put the algorithm on the stand.”

To better understand how to hold an algorithm accountable, Piskac and Shapiro consider a case in which one autonomous car hits another. With human drivers, lawyers can ask direct and indirect questions to get to the matter of who’s at fault, and what the drivers’ intentions were. For example, if a human driver can testify convincingly that the crash was unforeseeable and unintentional, the jury might go easier on them.

Just as human drivers do, automated decision-making systems make unsupervised decisions in complex environments — and in both cases, accidents can happen. As the researchers note, though, automated systems can’t just walk into a courtroom and swear to tell the whole truth. Their programs, though, can be translated into logic and subjected to reasoning.

Piskac and Shapiro and their team developed a system that uses automated reasoning, which can rigorously “interrogate” algorithmic behaviors in a way that mirrors the adversarial approach a lawyer might take to a witness in court. This method is a provable approach, they say, that guarantees accurate and comprehensive answers from the decision algorithm.

“ The basic idea is that we developed a tool that can almost mimic a trial, but for an autonomous system,” Piskac said. “We use a car because it’s something that people can easily understand, but you can apply it to any AI-based system.”

In some ways, an automated decision-​making system is the ideal witness.

“ You can ask a human all of these questions, but a human can lie,” she said. “But this software cannot lie to you. There are logs, so you can actually see — ‘Did you see this car?’ If it’s not registered in the log, they didn’t see the car. Or if it is registered, you have your answer.”

Using soid, built by Judson in Piskac’s lab, an investigator can pose factual and counterfactual queries to better understand the functional intention of the decision algorithm. That can help distinguish accidents caused by honest design failures versus those by malicious design practices — for instance, was a system designed to facilitate insurance fraud? Factual questions are straightforward (“Did the car veer to the right?”). Counterfactuals are a little more abstract, asking hypothetical questions that explore what an automated system might or would have done in certain situations.

“ Then, when you ask all these counterfactual questions, you don’t even need to guess if the AI program is lying or not,” Piskac said. “Because you can just execute the code, and then you will see.”

Indigent Defense Funding in Pennsylvania

60 of the 66 counties in pennsylvania with public defenders have criminal attorney staffing levels below current standards..

In September 2023, the RAND Corporation, in collaboration with the National Center for State Courts (NCSC) and the American Bar Association (ABA), published the National Public Defense Workload Study (NPDWS). This landmark study estimates the minimum time inputs required for public defenders to provide adequate representation that satisfies prevailing constitutional and professional standards in criminal cases. To calculate the implied minimum workload of public defender organizations in each Pennsylvania county, we applied these estimates to a dataset covering over 1 million criminal cases in Pennsylvania filed between 2016 and 2022 . Further, we compared this to actual staffing levels to identify areas with resource shortfalls. Our approach for estimating shortfalls was conservative, i.e. we analyzed the data and chose assumptions that will tend to minimize findings of inadequacy.

Key Findings

Statewide, public defenders are experiencing a substantial personnel shortfall. In a typical year, public defenders are assigned cases that would require over 1,200 full-time equivalent (FTE) attorneys to provide adequate representation, but there are only about 850 criminal attorney FTEs currently employed by public defender organizations in the state.

Shortfalls are pervasive but not universal—60 of the 66 counties with public defenders (91%) have criminal attorney staffing levels below current standards. However, there are counties that satisfy adequacy standards in varied regions of the state and within different county population categories.

For 50 counties (76%), there is no combination of estimates provided by any of the dozens of experts involved in the NPDWS that would allow us to conclude that the county has adequate personnel to handle its public defender’s criminal caseloads. Put differently, no matter which of the 33 different expert estimates from the NPDWS we choose to use, we would always conclude that there is a personnel shortfall in these counties.

For the first time in the 2023-2024 fiscal year, Pennsylvania authorized state funding for indigent defense; prior to this year, Pennsylvania was one of only two states that provided no state funding for indigent defense. The shortfalls created by an overwhelmingly local funding model may violate state and federal constitutional guarantees of access to counsel in criminal cases.
